Hi to all our readers:

In the coming days, we expect to unveil our new immigration site. It will
still have the same immigration information, but we think that the new
site will be even easier to navigate. Whenever we go online with our new
website, we will send you an e-mail to alert you. We are really
interested in your feedback. Any suggestions that you may have concerning
our site would be highly appreciated. Only through your comments can we
make it better.

As far as the news is concerned, those of you who have been visiting our
news update section regularly know that there has been a lot of movement
on the H-1B legislation issue. However, Congress will not be considering
the multiple bills to increase the cap until they come back to Washington
D.C. from their Easter recess. The one thing that has become clear is
that obtaining an increase in the cap might be harder than we initially
thought.

Some of the bills, most notably Lamar Smith's bill, have poison pills that
would render an increase in the cap effectively useless. For example,
Representative Smith's bill to increase the cap has a provision that would
make the cap conditional upon the Department of Labor and INS issuing
certain regulations that have been pending for more than two years. We
know that those agencies are not even close to issuing those regulations.
We will certainly keep you updated concerning with all the developments on
the H-1B cap. In the meantime, here are two cap-related developments that
we do know:

1) Processing of H-1B cap cases has been halted since April 17th. The INS
has not issued any statements as to when they will begin to process H-1B
cap cases. The halt was implemented in an effort to make sure that the
INS does not repeat last year's debacle of issuing more than 20,000 visas
in excess of the cap. As soon as the H-1B cap processing halt is lifted,
we will report it in our site;

2) Just in case Congress does increase the cap, INS has instructed the
public to put the start date as "10/01/2000 or earlier." Only petitions
with those magic words will be considered for approval dates before
10/01/2000 if Congress does eventually raise the cap;

3) Since last Thursday, the California Service Center has made much
progress in the processing of non-cap H-1B cases. We have been informed
that by the beginning of this week, they should be processing cases that
were filed in early January (last week they were processing November
cases!!!).
